What to Do When Tenants Stop Paying Rent Completely

At RCS Law, our eviction lawyers are here to guide landlords through tenant complications. While the idea of evicting a tenant may seem to be an unlikely situation to some, the hard truth is that sometimes it is the only rational next step. Let us help you evict tenants who stops paying rent.

It is not uncommon for tenants to experience temporary financial setbacks – life happens, and most landlords are understanding and willing to accommodate. The problem arises when a short-term arrangement becomes a long-term struggle, and the rent falls far into arrears.

Keep Track and Proceed Calmly

There are legal steps to follow when evicting a tenant. Begin by reviewing your signed lease agreement, payment records, and written communications with your tenant. Prepare as much documentation as possible, including a breakdown of rent arrears. Then, provide your tenant with a written notice that highlights their breach of contract and gives them time to remedy it (usually 20 business days).

Follow the correct process and do not take matters into your own hands, no matter how tempting it may be, or you could face serious consequences. South Africa’s PIE Act and Rental Housing Act prohibit landlords from cutting off utilities, changing locks, or behaving in any way designed to intimidate tenants and forcing them to leave.
